Benzene Exposure
Many times, people who are exposed to benzene never notice it in the moment. The chemical easily vaporizes, and can be breathed in or absorbed via the skin through casual contact. It is reported to even have a slightly pleasant smell, so it's uncommon for people to even notice they've been exposed to this cancer-causing agent, let alone be alarmed.
There lies the biggest problem in legal cases involving benzene and leukemia. Benzene is easily absorbed by the body but also easily removed from it. In the brief time that benzene is in the body, it can do incredible harm--including activating cancer genes that cause various kinds of leukemia. However, it is hard to prove that someone was even exposed, because tests are only accurate for a few days at most.
What's more, many companies will try to fend off lawsuits under the statutes of limitation, which say a crime must be prosecuted within a certain time period. Defense lawyers will claim that since no suit was filed at the time of exposure, then no suit can be filed. Depending on your state, there may be exemptions to the statues of limitation, or they may begin when you are diagnosed with leukemia.
